Dwight Howard Custody Battle: Ex-Girlfriend Seeks Temporary Custody of Daughter, Denied by Judge

The legal drama surrounding the eight-time NBA All-Star is escalating. Dwight Howard’s custody battle took a new turn this week when his ex-girlfriend Tiffany Render rushed to court seeking temporary custody of their 15-year-old daughter, Layla. The filing came just days after Howard’s estranged wife, Amber, made shocking drug allegations against him on social media.

Render filed the emergency custody modification on Monday, March 16, claiming in documents that Layla is “emotionally distressed” about returning to her father’s home. She alleged the teenager was recently admitted to a mental health facility after expressing thoughts of self-harm.

In her court documents, Render stated she has “serious and immediate concerns” about Layla’s well-being and safety. She claimed the situation has already resulted in involvement by the Georgia Division of Family and Children Services.

Render alleged that Layla “has repeatedly stated that she feels fearful and emotionally distressed about returning to her father’s home which she believes contributed to her crisis” . The filing included an affidavit signed by Layla herself, stating her mother had not pressured her to request the custody change .

The Dwight Howard custody battle intensified when Render requested an emergency hearing, citing “the urgency of Layla’s condition and the risk of further emotional harm” .

On Tuesday, March 17, a Georgia judge denied Render’s emergency request. The court’s response stated: “There are neither allegations nor evidence qualifying as emergent. Plaintiff failed to file the controlling custody order she seeks to modify”.

The judge also noted it wasn’t apparent from the filing whether the court even had jurisdiction to fulfill the request. However, if Render files additional documentation supporting her claims, the court will reconsider at a temporary hearing.

Render’s legal team has not yet indicated whether they will refile with the proper documentation.

Sources close to Howard tell a different story. They claim Render’s filing is “contrived” and point to the timing as proof . The source added that Render was “distressed when she lost custody of their daughter to Dwight” in January 2024.

Howard’s camp alleges Render has been “working in conjunction with Amber to get negative publicity for Dwight”. They maintain “there’s nothing in the police report that should be cause for concern for Layla”.

Howard’s legal team previously stated: “While he vehemently disputes the allegations made by Render, he will not speak negatively about her publicly, as it is his belief that the sanctity of Court Orders should be paramount”.

Howard was awarded primary custody of 15-year-old Layla in January 2024 after a bitter court battle. Render has been publicly critical of Howard’s parenting before, telling a magazine in March 2025 that he was “never a great father”.

The couple’s contentious history dates back to 2022 when Howard sought to reduce his monthly child support payments from $12,000 to $3,000. Render agreed to the reduced payments in July 2023.

Render previously explained why she stayed close to Howard despite their issues: “I was probably the only baby mama that was close to him and stayed his friend. I thought that kept me safe. I felt safe” .

This Dwight Howard custody battle unfolds against a backdrop of intense public scrutiny. Howard’s estranged wife Amber (also known as Amy Luciani) recently posted videos on Instagram claiming Howard has a drug addiction and that Child Protective Services removed his daughter from their home, claims Howard vehemently denies.

Howard filed for divorce from Amber on March 9, calling the marriage “irretrievably broken” after just over one year . In the two weeks leading up to the filing, police responded to Howard’s Georgia mansion multiple times, including for a suicide threat and a domestic incident.

On March 12, Howard announced his official retirement from basketball, stating he needed to “pour into my family”.

For now, Howard retains primary custody of Layla. The court has given Render a path to refile with proper documentation, but her emergency request failed. The teenager’s wellbeing remains at the center of a battle between parents who haven’t stopped fighting since 2022.

Render previously told reporters she planned to fight for full custody. That fight continues, just not on an emergency timeline.
