The legal drama surrounding actor Ian Ziering and the 2023 Hollywood Boulevard brawl has officially reached its conclusion. Jacob Hernandez, the motorbike rider who sued the Beverly Hills, 90210 star over an alleged assault, dismissed his lawsuit with prejudice on Tuesday. Ziering’s manager confirmed both parties have mutually agreed to drop all claims against one another.
Hernandez filed the lawsuit against Ziering alleging assault, battery, and intentional infliction of emotional distress stemming from the New Year’s Eve 2023 incident. He claimed the actor forcefully shoved him to the ground without provocation, causing physical injuries and ongoing mental health issues. The case has now been dismissed, with both sides looking to move forward.
Ziering’s attorney, Michael Kernan, delivered a pointed response to the dismissal, calling Hernandez’s lawsuit “frivolous” and a “transparent attempt to turn a victim into a defendant.” He emphatically stated that Hernandez received no settlement payment of any kind and argued that the dismissal completely vindicates his client.
The confrontation occurred while Ziering was driving with his daughter in Los Angeles. The actor has consistently maintained that members of a minibike group, which he identified as the 605 Gang, swarmed his vehicle and smashed his windshield while his child was still inside. He filed a police report following the incident.
Videos taken at the time showed a brawl erupt between Ziering and several men, with some footage appearing to show the actor initiating the physical confrontation. Hernandez was arrested and booked on a felony vandalism charge in 2024, though the case was not ultimately prosecuted . Hernandez had alleged Ziering used his celebrity status to push a biased narrative to the media, leading to his arrest.
With the mutual dismissal now finalized, both parties are free to put the two-year legal battle behind them. Ziering had previously sought to invoke California’s Anti-SLAPP statute to have certain claims thrown out, arguing the lawsuit amounted to “attempted civil extortion.” Now, the matter is closed.
