KJ Biermann Pleads Not Guilty in Sexual Battery Case, Seeks Juvenile Court

KJ Biermann is fighting the charges against him. The 15-year-old son of Kim Zolciak and Kroy Biermann entered a not guilty plea on Monday, October 5, 2026, to all seven felony counts in his sexual battery and sodomy case. His attorney, Jason Sheffield, entered the plea in Fulton County Superior Court and waived his formal arraignment, which was originally scheduled for October 14.

The KJ Biermann plea came with a strategic request. Sheffield asked the judge to set a hearing to transfer the case to Fulton County Juvenile Court before any pretrial or trial dates are set. If successful, the move would prevent KJ from being tried as an adult and could result in a less severe sentence if convicted. KJ was indicted in early September on seven felony counts: aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment, and three counts of sexual battery against a child under 16. The charges stem from an alleged incident on April 23, 2026, at a Life Time Fitness gym in Alpharetta, Georgia, involving a female classmate.

Sheffield has maintained his client’s innocence, calling it a “he said, she said” situation without DNA evidence. Kim Zolciak has publicly defended her son, stating he “categorically denies” the allegations. She claimed KJ voluntarily took and passed a polygraph examination and that an examination found no DNA belonging to him. The judge previously granted a request to seal certain documents in the case. The case remains in Superior Court for now, pending the judge’s ruling on the motion to transfer to juvenile court.
