The estate managing the legacy of late model and reality TV icon Anna Nicole Smith has filed a lawsuit against fashion label Von Dutch, accusing the brand of unauthorized use of her name and image in recent marketing efforts.

According to the legal complaint, Von Dutch allegedly used Smith’s likeness without obtaining the proper rights—neither during her lifetime nor from the estate that now oversees her intellectual property following her death in 2007. The estate claims that any use of Smith’s image in connection with Von Dutch products is a violation of her publicity rights.

The Controversial Post That Sparked the Lawsuit

The dispute focuses largely on a Facebook post made by Von Dutch in April, which featured a photo of Anna Nicole Smith from her 2004 appearance on The Tonight Show with Jay Leno. In the image, Smith is seen wearing a black cowboy hat with pink lettering, and the caption read:

However, the estate says the caption is misleading and false. A source close to the matter claims that the hat was not part of any official Von Dutch collection associated with Smith and that she made no reference to it during her Leno appearance. While Smith had collaborated with the brand in the past, the estate maintains that the previous agreement did not grant Von Dutch lasting rights to use her image, name, or association in future marketing campaigns.

Legacy Protection and Legal Ownership

Anna Nicole Smith—famed for her work as a model, actress, and reality star—passed away from a drug overdose in 2007 at age 39. Her estate, now managing her posthumous publicity rights, is determined to protect her brand and likeness from exploitation.

Her only child, Dannielynn Birkhead, turned 18 last year and now stands as a legal adult. However, her father, Larry Birkhead, has long played a key role in managing her late mother’s estate and image.

Awaiting Response

Requests for comment have been sent to Von DutchAnna Nicole Smith Inc., and Larry Birkhead, but none had responded as of the time of publication.

The case adds to the growing list of legal disputes involving the use of deceased celebrities’ likenesses in commercial ventures, further highlighting the importance of intellectual property and publicity rights in today’s media and fashion industries.
