Sean “Diddy” Combs’ legal team is making a renewed push for his release from jail as the embattled music mogul awaits sentencing on October 3. In a strongly worded court filing submitted Tuesday, his attorneys argued that Diddy is being treated unfairly and unjustly kept behind bars based on a “flawed” and “exaggerated” judgment of his character.
Lawyers Say Pre-Sentencing Jail Time Is Unwarranted
Diddy, who was acquitted earlier this month of the most serious sex trafficking and racketeering charges stemming from his alleged drug-fueled “freak-offs,” was found guilty on two lesser federal counts involving interstate prostitution. He now faces between two to five years in prison.
Despite his acquittal on the more explosive charges, U.S. District Judge Arun Subramanian ordered that the Bad Boy Records founder remain in custody, citing a past record of domestic violence and labeling him a potential danger to the public.
But Diddy’s lawyers — led by Marc Agnifilo — are pushing back hard, claiming their client is being unfairly made an example of.
“Sean Combs should not be in jail for this conduct,” the filing reads. “In fact, he may be the only person currently in a United States jail for being any sort of john.”
“There’s Never Been a Case Like This”
The legal team is painting the case as legally unprecedented. They argue that pre-sentencing detention is typically reserved for those running prostitution rings, not those who pay for consensual adult sex. They also question why Combs is the only one jailed, while others allegedly involved — including girlfriends, escorts, porn stars, and agency leaders — remain free.
“There has literally never been a case like this one,” the lawyers claim. “Mr. Combs is incarcerated while everyone else involved in this identical conduct… walk free, as they should.”
They also argue that Combs was “provoked” into his past violent actions, suggesting that the court has not considered the full context behind his behavior.
Diddy Offers Strict Bail Conditions
The legal filing outlines Combs’ willingness to comply with strict bail conditions, including a $50 million bond, travel restrictions, and electronic monitoring. His lawyers emphasize that he is not a flight risk, nor does he pose a threat to anyone’s safety.
“He will not be violent to anyone,” the defense insists.
