 “A Landmark Agreement”: Johnson & Johnson Offers $5.5 Billion to Settle 76,000 Baby Powder Lawsuits

Pharmaceutical and health giant Johnson & Johnson (J&J) has officially agreed to pay an estimated $5.5 billion to resolve roughly 76,000 lawsuits alleging that its talc-based baby powder and related products caused ovarian cancer.

The landmark deal aims to draw the curtain on more than a decade of aggressive legal battles. Despite agreeing to the multibillion-dollar payout, the New Jersey-based company firmly maintains that the claims are based on “junk science” and that its talc products are safe and free of asbestos.

The proposed settlement targets existing ovarian cancer claims pending in both federal and state courts across the United States.

 95% Approval Threshold: The settlement is contingent on receiving approval from at least 95% of eligible claimants to take effect.

 Payout Schedule: J&J expects to issue an initial payment of up to $3 billion in 2027, with the remaining installments scheduled no earlier than 2028.

 No Cap on Compensation: Plaintiffs’ attorneys noted that because the deal assigns specific values to qualifying claims without capping total liability, overall payouts could eventually rise to $7 billion or more.

 Focus on Existing Claimants: Unlike previous corporate settlement proposals that attempted to handle future claims via bankruptcy proceedings, this agreement strictly covers current plaintiffs, allowing eligible families to receive payouts faster—potentially within 18 months.

The settlement announcement follows years of complex legal maneuvering, including three failed attempts by J&J subsidiaries to resolve the liabilities through Chapter 11 bankruptcy filings (a legal strategy often referred to as the “Texas two-step”).

J&J pulled its talc-based baby powder from U.S. store shelves in 2020 and officially transitioned to a cornstarch-based formula globally. While the company has secured favorable verdicts in recent individual trials, representatives noted that moving forward with the settlement allows the company to put the costly litigation behind it and focus on developing life-saving devices and medicines.
