Musician and former Why Don’t We member Jack Avery is standing his ground against his ex-partner, influencer Gabbie Gonzalez, as their high-stakes legal battle intensifies. Avery has formally filed a response opposing Gonzalez’s latest bid for visitation and video calls with their seven-year-old daughter, Lavender.

The ongoing legal friction follows severe criminal charges brought against Gonzalez, who was arrested and accused of conspiring in an alleged murder-for-hire plot targeting Avery amid previous custody disputes. Gonzalez has pleaded not guilty.

 Protecting the Child’s Peace: Avery asserted in court documents that Lavender is currently “happy, healthy, and thriving” in his care, attending school, making friends, and participating in extracurricular activities.

 The Protective Order: Highlighting an active criminal protective order, Avery argues that granting visitation or calls right now would disrupt the child’s hard-earned stability and go against existing legal safeguards. Furthermore, he claims there is no true emergency requiring a change before their upcoming custody trial.

Avery’s position has received backing from close circles, including declarations filed by his ex-girlfriend Alexis Abner and Shelly Woodcox who briefly fostered Lavender following Gonzalez’s arrest voicing concerns over potential emotional distress and negative commentary. With the formal custody trial scheduled to head to court on October 20 and 21, both sides are bracing for a definitive legal showdown.
