In his written ruling, Leiter stated, “A reasonable jury could find that Mr. Baldwin recklessly disregarded the probability that pointing a gun in the direction of someone, with his finger on the trigger, would cause emotional distress.” While Baldwin has long maintained that he did not pull the trigger and was told the gun was “cold,” the judge noted that responsibility for set safety “does not relieve Mr. Baldwin of his duty of care” to those on set.
The lawsuit was filed by Serge Svetnoy, who was standing just feet away from cinematographer Halyna Hutchins when she was fatally struck. Svetnoy, who was not physically injured but was nearly hit by the same bullet, alleged that he suffered severe emotional distress. He famously described the “whoosh” of the gunshot and the trauma of cradling his friend’s head as she fell. While Judge Leiter allowed the negligence and intentional infliction of emotional distress claims to move forward, he dismissed a separate assault claim, finding no evidence that Baldwin intended to cause physical harm.
This ruling comes at a time when Baldwin has been attempting to put the legal fallout behind him. While several other civil cases—including one brought by the Hutchins family were settled in 2023 and 2025, Svetnoy’s case remained a lingering obstacle. The trial is tentatively scheduled to begin on October 12, 2026.
As the industry watches, the trial will likely scrutinize the breakdown of safety protocols that allowed a live round to enter the prop firearm. With the film’s armorer, Hannah Gutierrez-Reed, having already served her sentence for involuntary manslaughter, the civil court will now determine the extent of Baldwin’s personal and professional liability in one of Hollywood’s darkest chapters.
